Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

• Account means a unique account created for You to access our Service or parts of our Service.

• Application refers to SunHaze - UV Index & Tanning, the software program provided by the Company.

• Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to INFINITE PHASE LLC, Delaware, United States, the developer of SunHaze - UV Index & Tanning.

• Country refers to: United States

• Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.

• Health Data refers to information accessed from or written to Apple Health (HealthKit), such as your time in daylight and Vitamin D values, that You explicitly authorize the Application to read or update.

• Personal Data is any information that relates to an identified or identifiable individual.

• Service refers to the Application.

• Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

• Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

• Email address (if You create an Account)

• Profile information You provide, such as your skin type and sun preferences

• Usage Data

Location Data

The Application requests access to Your device location to provide its core functionality: calculating the real-time UV index, sunrise and sunset times, weather conditions, and safe sun exposure times for Your current location. With Your permission, We may also access Your location while the Application runs in the background to keep widgets and notifications up to date.

Your location coordinates are used to query weather and UV data from third-party weather providers. You can enable or disable location access at any time through Your device settings. Disabling location may limit or prevent core features of the Service from working.

Health Data (Apple Health / HealthKit)

With Your explicit permission, SunHaze can read daylight and Vitamin D information from Apple Health to personalize Your sun routine, and can write the Vitamin D You earn from tanning sessions back to Apple Health. Health Data accessed through HealthKit is processed on Your device to provide these features.

We do not use Health Data for advertising or marketing, and we do not sell Health Data. We do not share Health Data obtained through HealthKit with third parties except as required to provide the feature You requested or as required by law. You can revoke HealthKit access at any time in the Apple Health app or Your device settings.

Camera and Photos (AI Skin Analysis)

If You use the AI skin analysis feature, You may capture a photo with Your camera or select an image from Your photo library. These images are uploaded to Our AI processing provider in order to generate the skin analysis result You requested. The Application only accesses Your camera or photo library when You actively choose to use this feature.

Photos submitted for skin analysis are used solely to produce Your analysis result and are not used to train third-party models for unrelated purposes or sold to third parties. You may delete analysis results stored within the Service at any time.

Subscriptions and Purchases

SunHaze offers optional paid subscriptions. Purchases and subscription status are processed and managed through the Apple App Store / Google Play and Our subscription management provider. We do not collect or store Your full payment card details; these are handled by the applicable app store.

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), device type, operating system, the features of our Service that You use, the time and date of Your use, unique device identifiers and other diagnostic data.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

• To provide and maintain our Service, including to calculate UV index, safe sun time, tanning timers, and to provide widgets and notifications.

• To personalize Your experience: to tailor sun routines, recommendations and Vitamin D estimates based on Your profile, location and (with Your consent) Health Data.

• To manage Your Account: to manage Your registration as a user of the Service and give You access to its functionalities.

• To manage Your subscriptions: to process purchases and provide access to paid features.

• To contact You: to send You push notifications, such as UV alerts and reminders, and other communications related to the functionalities of the Service.

• To manage Your requests: to attend and manage Your requests to Us.

• For other purposes: such as data analysis, identifying usage trends, and evaluating and improving our Service and Your experience.

We may share Your personal information in the following situations:

• With Service Providers: We may share Your information with Service Providers to operate and analyze the Service, including weather and UV data providers, Our AI skin-analysis processing provider, authentication and cloud storage providers, and subscription management providers.

• For business transfers: We may share or transfer Your information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business.

• With Your consent: We may disclose Your personal information for any other purpose with Your consent.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. This information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from Your jurisdiction.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

Our Service may give You the ability to delete certain information about You from within the Service, including Your saved places and skin analysis results. You may also revoke location and HealthKit permissions at any time in Your device settings.

You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us. Please note that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially reasonable means to protect Your Personal Data, We cannot guarantee its absolute security.

Health and Sun Safety Disclaimer

SunHaze provides UV index, tanning timers, safe sun time estimates, Vitamin D estimates, and AI skin analysis for informational and educational purposes only. The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. UV exposure carries health risks, including skin damage and skin cancer. Always use sun protection and consult a qualified healthcare professional or dermatologist regarding Your skin health and sun exposure. Do not rely on the Service as a substitute for professional medical advice.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date at the top of this Privacy Policy.
